Boise, ID (CBS2) — On Friday, February 17, 2023, the Clean Slate Act was voted on by the Judiciary, Rules, and Administration Committee.
What the Clean Slate Act would do is allow those with minor non-violent, non-sexual offenses that have gone at least five years since the completion of their sentence including probation, parole, fines, and restitution, with no other offenses since their initial offenses to petition to have their public records sealed. This only applies to a single offense or the offenses of a single incident.
Law enforcement and prosecutors would still have access to the record. The shielding of the records can be revoked if the petitioner is convicted of a felony or misdemeanor and the prosecutor requests that the records be unsealed as part of the sentencing after that record had already been shielded from public view.
If a person does partition for their record to be sealed then they would have to cover the costs of the legal counsel, a person can only have one partition granted in their lifetime.
